Personal injury claims

What are personal injury claims?

Firstly a ‘personal injury’ is an injury or illness which was caused due to somebody else’s fault or negligence. If you’ve been injured as a result of a non fault accident and the negligence of another person which has resulted in your suffering from an injury then you could be entitled to making a claim for personal injury

When you make a claim for Personal injury, you will be making a claim from the negligent parties insurers. This will include any compensation that you are entitled to for injury as well as claiming for any other losses such as time off work, costs related to injury recovery such as medication or items that may have been broken as a result of the accident.

Can you make a claim?

When making a claim there are a few things that are important to establish if you can make a claim. This includes the following

When the accident happened- You will need the exact date and location

You must be able to explain how the accident happened

Details of the person you believe is responsible such as car registration details

The Injury that you suffered from

How long you were injured for (minimum is 4 weeks)

Did you visit the GP or hospital (This would strengthen your claim)

The above list provides you with the basic details required to make a claim for personal injury

If you believe that the accident happened as a result of someone else then the best way to find out is normally by speaking to a solicitor. The solicitor would ask you a series of questions that will help establish if the accident was the fault of the other party. Even if you are unsure, you do not need to hesitate to make a claim as the solicitors can find out if you are entitled to making a claim

There is usually a time limit of three years to make a personal injury claim. This starts either from the date the accident happened, or from when your first found out that an injury was caused .It is always advisable to make a claim as soon as possible to avoid delays

DID YOU KNOW:

You can make a claim for compensation even if the responsible party cannot be identified, these are normally claimed through the MIB or CICA.
