Slip, Trip or Fall

We all walk out on the public road daily, visit local supermarkets and shopping centres and not expect anything to happen. However, a slip, trip or fall is never out of the question whilst being in any of these places. You would be surprised to hear many clients claiming for personal injury do so after suffering from a slip, trip or fall.

What is a Slip, Trip or Fall?

An unfortunate fall can happen in any situation. You could be walking normally on a public road where there may be a raised pavement or tile and you, unfortunately, catch your foot resulting in a painful fall. You could be visiting your local supermarket where someone may have spilled water on the floor or even a piece of fruit, on which you slip over.

How do Slip, Trip and Fall Claims happen?

Most Slip trip and Falls occur due to a public or private organisation being negligent to the public. They can happen anywhere at any time, causing you a major or even a minor injury. Most common reasons being;

  • Pavements being maintained badly
  • Potholes
  • Pavements not being gritted during winter
  • Poorly maintained parks (Public and private)
  • Oil, water or food spillages
  • Trailing Cables
  • Poorly installed carpet
  • Loose Carpeting or flooring
  • Unsafe Stairs

What types of injuries can you claim for?

Some of the most common types of injuries that we help with are slips, spillages in supermarkets, Trips happening over defective surfaces on a public pavement. Slips in bars and clubs, Trips happening on poorly laid carpets or rugs and even badly designed staircases.

This is one of the most common types of accidents that cause injuries. Whilst these accidents occur in a huge variety of circumstances, if the accident has happened as a result of someone else’s fault then you can make a claim to compensate you for your injuries.

How much compensation can you claim?

There are many factors taken into consideration when your solicitor is making a personal injury compensation claim for you. Below are some of the factors that are taken into consideration when it comes to the compensation amount you will receive;

  • Treatment Required
  • Length of Treatment
  • Impact on your daily life
  • Loss of earnings
  • Length of Injuries
  • Severity of injuries

No Legal expert will be able to give you any amount until they have all the evidence and have fully assessed your claim.

What information do you need to obtain to make a claim?

Just like all other Accident claims, its important to obtain as much information regarding your accident. However, with Slip, Trip and Fall Accidents, it is very difficult to make a compensation claim if you do not have any photographic evidence of what caused you to fall.

Below are some guidelines of what information you will need to make a compensation claim for a slip, trip or fall;

Location of Accident

It is important you obtain the exact location of the accident. If it helps, try to remember some landmarks that were around you at the time. If you have the wrong accident date, this can affect your claim as it may have been repaired or inspected etc.

Time

You must try to remember the exact time the accident took place. This can affect your compensation claim if you do not have the correct time.

Witnesses

If you had any witnesses, obtain their contact details. This will make your claim stronger if someone saw the accident happen.

Photographic Evidence

Pictures are important when making a claim for a slip, trip or fall. As this will be your main source of evidence when making a compensation claim. Evident pictures must show the depth of the holes or raised slabs. You can use a ruler, coin or a measuring tape to measure this.

We understand that when you are injured and have just had an accident, obtaining information is the last thing on your mind. If you have someone with you at the time of the accident, you could ask them to help take pictures and all the above information. If you have any witnesses, they are usually happy to help you gather information required.

Don’t worry if you were alone at the time of the accident, you can always go back to the location of the accident a few days later and obtain the photographic evidence.

Seek Medical Attention

It is important that after any type of accident you seek medical attention. Even if the injury seems to be minor. Some minor injuries can result in suffering internal pain or internal damage. This will also be favourable to you when making an injury compensation claim.

Claiming for an accident in a public place.

If you have been injured as result of an accident in a public place due to atrip ., slip or fall may be in a shop, supermarket , a bar, restaurant or any other place that you visited, then you could be claiming for compensation if you suffered an injury as a result.

In general terms the owners owe you a duty of care to ensure that the environment is safe and if there are any hazards , then this should be clearly displayed.

The staff have a legal responsibility to record any incidents occurring and keep a record of them in the accident book. This provides strong evidence so please report this if you have not done so.

Another very important point is to report the injury resulting from the accident to your doctor, this also supports any claims that you make.
